Definition of a Personal Injury Claim in Westport, MO
A personal injury claim is your right under Missouri law to get monetary reimbursement for the damage another person caused, and to achieve justice. The purpose of insurance settlements and civil litigation is to make one whole. The idea is to put you in the same position you were in before another person injured you.
In some cases, no outcome in your claim can truly “put back” all the things you lost in an injury. While you can be reimbursed for the financial losses you sustained, other damages are harder to quantify. If a family member died, you are permanently disabled, are disfigured or will have to live the rest of your life in chronic pain, no amount of money can make that go away. What compassionate and talented personal injury lawyers like those at Burger Law are able to do is secure you fair compensation in order to provide a sense of justice and acknowledgment, and to provide you with relief from the financial losses resulting from your accident.
Is it Worth Hiring Personal Injury Lawyer in Westport, MO?
While some cases can be successfully navigated without a lawyer, most of the time you will need one to recover the full value of your claim in Westport, MO. The important question is, can they increase my compensation? If your injuries were not severe, you did not miss much time off work and the other party’s fault is clearly established, you may not need an attorney. But, you will need an attorney in Westport, MO under the following circumstances:
- There is disagreement about who is to blame, or the insurance company says the injuries are your fault
- The insurance company is denying they have to cover certain damages
- Your injuries are significant and require extensive medical treatment
- There are multiple parties that is liable for your damages
- Your damages are more than the liable policyholder’s policy limits
We offer consultations for free, and we will always be honest with you about how much we can help your claim. Our personal injury lawyers work on a contingency-fee basis, meaning you do not pay until we win your case, and we have no reason to take on your claim if we do not think we can get you substantially more money.

Do I Have a Personal Injury Case in Westport, MO?
While state statutes can be confusing, whether or not you can seek compensation depends on the answer to one particular question: did someone else’s negligence cause you injuries? From a legal standpoint, you have to prove the five elements of negligence:
- Duty of care — You first need to demonstrate that the liable party had an obligation to keep you safe. Sometimes, a duty of care is assumed, as Westport, MO driver owe everyone else on the roads a duty of care, or store owners need their properties to be reasonable safe for anyone who legally enters. Other times, a special relationship must have been agreed to, for example a doctor-patient relationship or a vendor-patron relationship.
- Breach of duty — Did the other party fail in that obligation? Did a driver crash into you you while they were not following the rules of the road? Did a doctor fail to diagnose a condition? Did a store owner fail to fix an obviously dangerous condition?
- Causation — You must show how the accident led to your injuries. For instance, you broke your arm when your car was t-boned, or had bad side effects from a prescription drug.
- Proximate cause — This determines who needs to be held accountable. If you were rear ended, it is usually because another driver broke the rules of the road. But if the brakes were not safe, a manufacturer or mechanic may be the one who is ultimately liable.
- Damages — Finally, you need to demonstrate that you sustained some form of financial loss as a direct result of your injuries. In personal injury cases, this is usually medical bills and wages you could not earn while you were not able to work. If you keep solid records of your medical expenses, an attorney will be able to establish your financial losses with an insurance company. Once we establish financial losses, we can also seek a financial recovery for less tangible losses.

What Is the Personal Injury Claims Process in Westport, MO?
The journey to securing maximum compensation for your injuries can be long and complex. While some accidents and injuries settle fairly early, others can take several years before a jury finally renders a verdict. In total, the path to getting compensation consists of:
- Getting Medical Treatment — Seek medical care as soon as possible after an injury, and do not miss any appointments with your doctor, chiropractor or physical therapist. Waiting too long could bring complications to your claim, and not attending all your sessions will lower both your economic and noneconomic damages. Our personal injury lawyers know experienced Westport, MO doctors, chiropractors and physical therapists who can help you in your recovery.
- Consulting With an Attorney — Even if you are not sure you are going to need legal representation, you need to consult with one as soon as possible so they can become familiar with your case. A good lawyer will tell you bluntly what your legal options are.
- Investigation and Documentation — Once you have legal representation, your personal injury lawyer will carry out a full investigation into the circumstances surrounding your injuries, determine every liable party and obtain the evidence they need to get you full compensation. You should also keep detailed records of your expenses related to your injuries, and how keeping a journal detailing how your injuries have affected your life.
- Settlement Demand and Negotiations — Once we know how much your claim is worth, we will send a settlement demand package to those who are liable for compensating you. In the package we will include full documentation of all of your damages, and insist that nothing but the full amount is acceptable. Most of the time, the insurance company will counter our offer with a lower number, and there will be several back-and-forths until they decide to be truly fair.
- Filing a Lawsuit — If negotiations do not result in fair compensation, we will proceed to litigating the case and setting up a trial. During this time, both parties continue negotiating.
- Mediation — Mediation is often the last chance for an agreement before trial. In mediation, an objective third party listens to arguments from both sides and tries to break the stalemate.
- Pre-Trial — If mediation still does not result in a fair settlement, the “discovery” phase begins. In this phase, we will speak to eyewitnesses and expert witnesses, gather more evidence and both parties will share with the other what they plan to use as evidence in trial.
- Trial — Only six percent of personal injury claims go to trial. In fact, we often finally get the settlement we were seeking in the weeks immediately before trial. However, if the insurance company refuses to do the right thing, the case will go in front of a judge and jury. Trial consists of:
- Voir dire
- Opening statements
- Testimony and cross-examination
- Closing arguments
- Jury instruction
- Jury deliberation and verdict

This law firm is absolutely amazing. They took on my case, when nobody else would! They fought hard for me when it seemed there was no hope. They kept me informed and always asked for my input before making decisions on my case. Gary puts himself into every case unlike most law firm owners. Gary and his team really care about every one of their clients, and fights hard to get you a fair settlement. They actually won my case out of court, and then reduced my fees to make sure I could get my car fixed and be able to get back to some normality. I would recommend Burger Law over and above any other firm! If you go somewhere else you aren’t getting the best!
